Almost always, yes. The kind of basement excavation people want in Kensington & Chelsea needs full planning permission, and the borough’s basement policy puts firm limits on how big and how deep it can go.

What RBKC’s basement policy actually says

The rules are stricter than most people expect. RBKC’s basements planning policy restricts a basement under the garden to no more than half the garden, and limits depth to a single storey in most cases, which it describes as roughly three to four metres floor to ceiling (with a small extra allowance for a pool). More than one storey, or greater garden coverage, is generally only considered on large comprehensively planned sites, not ordinary homes. The double-storey “iceberg” basement under house and garden is, for most residential streets, off the table.

If your home is listed or in a conservation area, which covers much of the borough, you’ll need consent for that on top.

The Party Wall Act is not optional

Separately from planning, a basement almost always triggers the Party Wall etc. Act 1996, because you’re excavating near or below a neighbour’s structure. For excavation you serve notice at least one month before you start, and if the adjoining owner doesn’t consent within 14 days a dispute is deemed to have arisen and surveyors are appointed. It’s a legal process with real deadlines, so start it early rather than late.

Ground and water matter

Much of the borough sits on London Clay, with river gravels and a higher water table closer to the Thames. That shapes the waterproofing, the underpinning and the structural design, and it’s the reason a proper ground investigation isn’t a corner you cut.

What the process looks like

Feasibility and survey first, then design and structural engineering including the method statement the borough expects, then planning (and listed-building consent if it applies), then party-wall notices, then the build itself: excavate, underpin, waterproof, fit out. Expect several months on site, plus lead time before a spade goes in.
